NewERA Automation LLC ("NewERA," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect on neweraautomation.com (the "Site"), how we use it, and your rights under the Texas Data Privacy and Security Act (TDPSA) and other applicable law.

This Policy applies to visitors and prospective clients who interact with our Site. It does not govern data processed under a signed client services agreement — that data is governed by the applicable Master Services Agreement.

1. What Information We Collect

1.1 Information You Provide

When you submit our contact form, we collect:

  • Your name
  • Your email address
  • The content of your message

We do not collect payment information through the Site. Billing for client engagements is handled separately through our invoicing process.

1.2 Information Collected Automatically

We do not use third-party analytics or tracking tools, so we do not track your browsing across the Site. When you submit the contact form, our systems and our hosting provider process limited technical data — your IP address and browser type — for security and spam prevention.

2. How We Use Your Information

We use the information we collect to:

  • Respond to your inquiry or contact form submission
  • Evaluate whether NewERA's services are a fit for your needs
  • Improve the Site's content and user experience
  • Comply with our legal obligations

We do not use your contact form information for mass marketing or add you to any mailing list without your explicit consent.

3. How We Share Your Information

We do not sell your personal information. We do not share your personal information with third parties for their marketing purposes.

We may share information in the following limited circumstances:

  • Service Providers: We use third-party tools to operate the Site (e.g., hosting). These providers process data only on our behalf and under our instructions.
  • Legal Requirements: We may disclose information if required by law, subpoena, or court order, or if we believe disclosure is necessary to protect our rights or comply with a legal process.
  • Business Transfer: If NewERA is acquired, merged, or its assets are transferred, your information may be transferred as part of that transaction. We will notify you before your information is subject to a materially different privacy policy.

4. Legal Basis for Processing

We collect and process your information based on:

  • Your consent (e.g., when you submit our contact form)
  • Our legitimate interest in operating and improving the Site
  • Compliance with applicable legal obligations

5. Cookies and Tracking Technologies

We do not use third-party analytics, advertising, or tracking cookies on the Site, and we do not track you across other websites. The Site sets only strictly-necessary, first-party cookies required for security and core functionality, such as a session cookie and a CSRF-protection token used by our secure login. These cookies are not used for analytics, advertising, or cross-site tracking, and under applicable law they do not require your consent.

6. Your Rights Under Texas Law (TDPSA)

If you are a Texas resident, you have the following rights with respect to your personal data:

  • Right to Know: You may request confirmation of whether we process your personal data and obtain a copy of it.
  • Right to Correct: You may request that we correct inaccuracies in your personal data.
  • Right to Delete: You may request deletion of personal data you have provided to us.
  • Right to Opt Out of Sale: We do not sell personal data, so this right is not currently applicable.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights.

To exercise any of these rights, contact us at hello@neweraautomation.io. We will respond within 45 days. If we cannot fulfill your request, we will explain why.

If you are not satisfied with our response, you may appeal by emailing hello@neweraautomation.io with the subject line "Privacy Rights Appeal." If your appeal is denied, you may contact the Texas Attorney General's Office.

7. Data Retention

We retain contact form submissions for up to 24 months from the date of receipt, unless you request earlier deletion or we enter into an ongoing client relationship, in which case our MSA governs retention.

8. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

9. Children's Privacy

The Site is not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If we learn we have inadvertently collected such information, we will delete it promptly.

10. Third-Party Links

The Site may contain links to third-party websites. This Privacy Policy does not apply to those sites. We encourage you to review the privacy policies of any third-party sites you visit.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last Updated" date at the top of this page. If changes are material, we will provide additional notice (e.g., a notice on the Site). Your continued use of the Site after any changes constitutes acceptance of the updated Policy.
